The Supreme Court has slated February 6 for judgement in the legal dispute over the All Progressives Congress (APC) senatorial ticket for Yobe North between Bashir Machina and the Senate president , Ahmad Lawan.
The APC is challenging the nomination of Bashir Machina as the party’s candidate for Yobe North Senatorial District, insisting that , Ahmad Lawan, is the right Senatorial candidate for Yobe North for the forthcoming general election.
At the hearing today, Wednesday, the APC’s lawyer, Sepiribo Peters, argued that the primary election of the APC held on 28 May, 2022, which produced Machina was in breach of the Electoral Act.
Peters said that the primary conducted by Danjuma Manga cannot stand as he was not nominated by the National Working Committee (NWC) of the party and that the APC cancelled the primary poll on account of the irregularities observed during the exercise.
He opined that the other primary conducted on 9th June by the APC NWC that produced Ahmed Lawan as the party’s was the authentic one for the February 25 poll.
Machina’s lawyer, Sarafa Yusuff, prayed the Supreme Court to dismiss the appeal for lacking in merit, and that the APC did not challenge Machina’s suits at both the trial and lower courts.
Justice Centus Nweze and the five man panel, after listening to both lawyers submission, fixed February 6 for judgement.
