The Sharia Court sitting in Kubwa, Abuja on Tuesday dissolved a 15 years marriage between Adepoju Modia and Abdulazeez Lawal.
The presiding Judge, Garba Gambo divorced the marriage on the ground of irreconcilable disagreement.
The dissolution of the marriage is done in accordance with the Islamic law.
The wife, Adepoju, a school teacher, had approached seeking the dissolution of her marriage to her husband on the ground of neglect and assault.
The woman claimed that the husband has not been taking care of her and their three children.
The respondent hasn’t been paying the children’s school fees, yet comes around, beats me, eats my food despite having left us for 5 years, says Adepoju.
She told the court that she alone has been carrying the family burden from her meagre monthly earning of N40,000. Adepoju stressed that she has been the only one paying their school fees.
She added that anytime she asks for a refund or money from her husband, (Abdulazeez) he always assaults her. On several occasions, she said it is the neighbours that come to her rescue.
She said that ” the respondent left the house in which they reside in 2007, when the rent was about to expire. She said she was forced to relocate in 2020 when she couldn’t cope.
“The respondent started intermittent visits to her new resident and disposed her of her little savings. , the respondent is not jobless and has never been jobless. He is a teacher, the respondent has been making life difficult for the petitioner.”
She therefore prayed the court to dissolve the marriage.
“The Petitioner is hereby seeking from this honourable court the dissolution of the marriage between her and the correspondent “.
Abdulazeez however denied all allegations, stating that he already told her he ‘divorced her on the 15th of July 2022’.
Adepoju denied knowing that, saying that if she had known he said that, she would never have brought the case to a court for hearing.
The judge then dissolved the marriage according to the Muslim law, asking the couple to get their divorce certificate.
The Muslim law states that when a man says he no longer interested in marrying his wife, then the marriage no longer exists.
The Case was adjourned for hearing on the 15th November 2022 as regards Custody and maintenance of the Children.
