….Grants an injunction restraining DSS from detaining Emefiele
Another High Court sitting in Abuja has voided the arrest and detention of the Suspended Central Bank Governor, Mr. Godwin Emefiele, by the Department of State Services.
NewsSpecng had reported that an Abuja High Court on Thursday issued a seven day ultimatum to the DSS to either charge Emefiele to Court or set him free .
But Justice Bello Kawu, who delivered the latest judgement on Friday, held that the actions of the DSS were in violation of a previous judgment and orders issued by Justice M. A. Hassan.
In response to this, Mr. Emefiele’s counsel, Peter Abang, requested the court to nullify the arrest and detention, considering it illegal due to the existing judgment delivered by another court on December 29th, 2022.
Justice Kawu further ordered the setting aside of any arrest warrant obtained by the respondents, specifically the DSS, for the arrest of Emefiele on charges related to terrorism financing, fraudulent practices, money laundering, and threats to national security.
Additionally, the court granted an injunction that prohibits the respondents, particularly the DSS, from arresting, detaining, or interfering with Mr. Emefiele’s personal freedom and movement.
Finally, the court ordered the immediate release of Mr. Emefiele from any arrest or detention and mandated the respondents, especially the DSS, to comply with this order.
